By purchasing products through the Online Store, the Buyer confirms that they have read and accepted these General Terms and Conditions.
For matters not regulated by these General Terms and Conditions, the applicable laws and regulations of the Republic of Croatia shall apply.
2. DEFINITIONS
For the purposes of these General Terms and Conditions:
“Seller” means The Path Of Awakening d.o.o.
“Online Store” means the Supreme Choice Minerals online store.
“Buyer” means a natural or legal person who orders or purchases a product.
“Consumer” means a natural person who enters into a contract for purposes unrelated to their business, trade, craft or professional activity.
“Product” means any product offered for sale through the Online Store.
“Contract” means the sales contract concluded between the Seller and the Buyer through the Online Store.
3. PRODUCTS
The Online Store offers crystals and minerals, bracelets, pendants, jewellery and accessories, sets, gift packs and other products.
The Seller provides accurate information about the material, dimensions, weight, colour, contents and other relevant characteristics of each Product.
Product photographs are provided for illustrative purposes. Natural minerals and crystals may differ slightly in colour, pattern, structure, shape or size due to their natural characteristics. Differences in colour may also occur due to lighting conditions or differences in the display settings of individual devices.
Such differences shall not in themselves be considered defects where they result from the natural characteristics of the material or from characteristics clearly stated in the Product description.
4. INFORMATION ABOUT CRYSTALS, MINERALS AND THEIR PROPERTIES
Any symbolic, traditional, spiritual, aesthetic or other properties attributed to crystals and minerals and presented in the Online Store are provided for informational and descriptive purposes only.
Such information does not constitute medical advice, diagnosis, treatment, prevention or therapy and does not replace advice or treatment provided by a doctor, psychologist or other authorised healthcare professional.
The Products are not presented as a substitute for medical or other professional healthcare.
The Buyer is responsible for using the Products safely, for their intended purpose and in accordance with any applicable instructions and warnings.
5. PRICES
All Product prices displayed in the Online Store are stated in euros (EUR).
Unless expressly stated otherwise, the displayed price is the retail price and includes VAT and other applicable public charges.
Shipping costs and any other additional costs shall be clearly indicated to the Buyer before the Contract is concluded.
The Seller shall comply with the retail price displayed at the time the order is placed.
The Seller may change prices for future orders. Such changes shall not affect already confirmed orders, except in cases of an obvious technical or computer error.
6. SPECIAL FORMS OF SALE, DISCOUNTS AND PREVIOUS PRICES
The Seller may offer Products under discounted prices or other special sales conditions.
Where a Product is advertised as being on sale or under another special form of sale for which the law requires the previous price to be displayed, the Seller shall, together with the current reduced price, display the lowest price at which the same Product was offered by the Seller during the 30-day period preceding the reduction, or other information required by applicable law.
The Seller shall not arbitrarily determine a previous price for the purpose of creating the appearance of a larger discount.
Where a discount or other benefit is advertised, the Buyer should rely on the clearly displayed current retail price and the legally required previous/lowest price information.
7. ORDERING AND CONCLUSION OF THE CONTRACT
The Buyer selects the Product, quantity and any available options and adds the Product to the shopping cart.
Before submitting the order, the Buyer may review and correct the entered information.
Before final confirmation of the order, the Buyer is shown the selected Products, prices, shipping costs and the total amount to be paid.
By submitting the order, the Buyer confirms that they have reviewed the order details and that the order entails a payment obligation.
The Seller shall send the Buyer an order confirmation by e-mail.
An automatically generated confirmation may constitute only a technical confirmation of receipt of the order if this is clearly indicated.
The Contract is concluded when the Seller accepts the order or in the manner otherwise clearly indicated to the Buyer during the ordering process.
8. PRODUCT AVAILABILITY
The Seller makes reasonable efforts to keep information about Product availability up to date.
If an ordered Product is unavailable after the order has been placed for a justified reason, the Seller shall inform the Buyer without undue delay.
If the Buyer has already paid for a Product that the Seller cannot supply, the Seller shall refund the amount paid in accordance with applicable law.
9. PAYMENT
One or more payment methods may be offered during the ordering process.
The payment methods available at the time of purchase are the applicable payment methods for that order.
If payment by bank transfer is available, the necessary payment details shall be provided to the Buyer.
If payment is made by card or through another payment service provider, the payment is subject to the terms of that provider and to the mandatory rights of the Buyer under applicable law.
Card payment data is processed through the relevant payment service provider in accordance with its rules and applicable law.
10. DELIVERY
Products are delivered to the delivery address provided by the Buyer.
Available delivery areas, delivery methods, estimated delivery times and delivery costs shall be indicated to the Buyer before the Contract is concluded.
Any special delivery costs shall be displayed before the Buyer confirms the order.
The Seller shall take reasonable measures to deliver the Product within the agreed or legally applicable delivery period.
If an incorrect or incomplete delivery address provided by the Buyer results in unsuccessful delivery or additional delivery costs, the Seller may request the necessary information from the Buyer and arrange re-delivery, while respecting the Buyer's statutory rights.
For international shipments outside the European Union, any import duties, customs charges, taxes or fees imposed by the destination country may be payable by the recipient, where applicable and unless otherwise expressly stated.
11. RECEIPT OF THE SHIPMENT AND DAMAGE TO THE PACKAGE
The Buyer is advised to check the shipment for visible damage upon delivery.
If the package is visibly damaged, the Buyer may, where possible, request that the carrier record the damage.
Regardless of whether such damage is reported immediately, the Buyer's statutory rights regarding non-conformity or damage remain unaffected.
Failure to immediately report visible external damage to the package does not in itself result in the loss of any mandatory statutory rights.
12. RIGHT OF WITHDRAWAL
A Consumer who enters into a distance contract has the right to withdraw from the Contract without giving any reason within the statutory period, unless an exception provided by law applies.
For the sale of goods, the withdrawal period is generally 14 days from the day on which the Consumer or a third party designated by the Consumer, other than the carrier, acquires physical possession of the goods.
Where the Consumer orders several goods in one order that are delivered separately, or where one Product is delivered in several shipments, the withdrawal period begins when the Consumer or a third party designated by the Consumer acquires physical possession of the last good or the last shipment, as applicable.
The Consumer may exercise the right of withdrawal by sending an unambiguous statement before the expiry of the withdrawal period.
The withdrawal statement may be sent by e-mail to supremechoiceminerals@gmail.com or by post to the Seller's address stated in these General Terms and Conditions.
The Consumer may use the statutory withdrawal form made available by the Seller through the Online Store.
The Consumer is not required to state a reason for exercising the right of withdrawal.
If the Online Store provides an electronic withdrawal function, the Consumer may also use that function.
13. EFFECTS OF WITHDRAWAL
If the Consumer validly exercises the right of withdrawal within the applicable period, the Seller shall refund all payments received from the Consumer under the Contract without undue delay and no later than 14 days from the day on which the Seller receives the Consumer's withdrawal statement, in accordance with applicable law.
The refund shall include the standard delivery costs paid by the Consumer, but shall not include any additional costs resulting from the Consumer's choice of a delivery method more expensive than the least expensive standard delivery method offered by the Seller.
For contracts concerning goods, the Seller may withhold the refund until the goods have been returned or until the Consumer provides evidence that the goods have been sent back, whichever occurs first.
The refund shall normally be made using the same means of payment used by the Consumer for the original transaction, unless the Consumer expressly agrees otherwise and provided that the Consumer does not incur any additional costs as a result.
The Consumer shall return the goods without undue delay and, in any event, within the statutory period applicable to the withdrawal.
The direct cost of returning the goods shall be borne by the Consumer unless the Seller has agreed to bear such costs or has failed to inform the Consumer before the Contract was concluded that the Consumer would be responsible for the return costs.
The Consumer shall be liable for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics and functionality of the goods.
14. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
The right of withdrawal does not apply in cases expressly excluded by applicable law.
If an exception applies to a specific Product, the Consumer shall be informed before the Contract is concluded, where required by law.
15. NON-CONFORMITY OF PRODUCTS AND COMPLAINTS
The Seller is responsible for the conformity of the Products and for material defects to the extent and within the periods prescribed by applicable law.
In consumer contracts, the Seller's statutory liability for material defects generally applies for two years from the delivery of the goods, unless applicable mandatory law provides otherwise.
The Buyer may submit a complaint by e-mail or post using the Seller's contact details stated in these General Terms and Conditions.
A complaint may include the Buyer's name, order number, Product concerned, description of the problem, date of purchase and, where appropriate, photographs or other supporting documentation.
The exercise of statutory rights does not depend on whether the Product is still being offered for sale by the Seller.
16. WRITTEN CONSUMER COMPLAINTS
A Consumer may submit a written complaint in a manner that enables the Seller to confirm receipt of the complaint.
Complaints may be submitted by e-mail or post.
The Seller shall confirm receipt of the complaint and provide a written response within a maximum of 15 days from receipt of the complaint, clearly stating whether the complaint is considered justified.
The Seller shall keep records of written consumer complaints on a durable medium for one year from the date of receipt, in accordance with applicable law.
17. PRODUCT SAFETY AND INTENDED USE
Products must be used in accordance with their intended purpose, instructions and warnings, where applicable.
Where age restrictions or warnings apply, these shall be indicated where appropriate.
Small parts may pose a risk to young children. The Buyer is responsible for appropriate storage and safe use of Products in accordance with their intended purpose.
18. INTELLECTUAL PROPERTY
All content published in the Online Store, including texts, photographs, graphics, logos, designs, names, Product descriptions and other materials, is protected by copyright, trademark and other applicable intellectual property laws.
Copying, distribution, reproduction or commercial use of such content without the Seller's prior written consent is prohibited, except where permitted or required by mandatory law.
The purchase of a Product does not grant the Buyer any rights to use the Seller's trademarks, logos, photographs or other protected content.
19. PERSONAL DATA PROTECTION
Personal data is processed in accordance with applicable data protection legislation.
Detailed information regarding the processing of personal data, legal bases, retention periods, data subject rights and contact details is provided in the Seller's separate Privacy Policy.
The Privacy Policy is a separate document and does not replace these General Terms and Conditions.
20. COOKIES
The Online Store may use cookies and similar technologies.
Information regarding the types of cookies used, their purposes, storage periods and consent management is provided in the Seller's separate Cookie Policy.
21. SELLER'S LIABILITY
The Seller does not exclude or limit any liability that cannot legally be excluded or limited.
Nothing in these General Terms and Conditions affects the Consumer's mandatory statutory rights.
The Seller shall not be liable for temporary unavailability of the Online Store caused by circumstances beyond the Seller's reasonable control, including technical failures, telecommunications interruptions, failures of third-party service providers or force majeure, except where applicable law provides otherwise.
22. ERRORS IN CONTENT AND PRICES
The Seller makes reasonable efforts to ensure that information published in the Online Store is accurate and up to date.
If an obvious technical or computer error results in an obviously incorrect price or other material error, the Seller shall inform the Buyer when the error becomes known.
If an order cannot be fulfilled due to an obvious error, the Seller shall act in accordance with applicable law.
If the Buyer has already paid an amount that must be returned, the Seller shall refund that amount in accordance with applicable law.
23. AMENDMENTS TO THE GENERAL TERMS AND CONDITIONS
The Seller may amend these General Terms and Conditions for reasons including changes in legislation, business operations, the Online Store or other justified reasons.
The new version shall be published together with the date of the latest update.
A Contract already concluded shall be governed by the version of the General Terms and Conditions in force at the time the Contract was concluded, unless mandatory law provides otherwise.
24. GOVERNING LAW
These General Terms and Conditions and the contractual relationship between the Seller and the Buyer shall be governed by the laws of the Republic of Croatia, while respecting mandatory consumer protection rules applicable to the Consumer.
A Consumer residing in another Member State of the European Union retains the protection afforded by mandatory provisions of the law that would otherwise apply to the Consumer, where applicable.
25. OUT-OF-COURT DISPUTE RESOLUTION
The Seller shall seek to resolve disputes amicably whenever possible.
Consumers may use alternative dispute resolution mechanisms available under applicable law.
Information regarding available bodies and procedures may be obtained from the competent authorities and official sources.
